The Federal Motor Carrier Safety Administration (FMCSA) is proposing to delete the requirement for no-defect driver-vehicle inspection reports (DVIRs) for intermodal equipment. The Notice of Proposed Rulemaking (NPRM) came as no surprise to regular readers of the Federal Register. Just last month, FMCSA announced that it was delaying until June 30, 2012 the implementation date of the rule requiring drivers to file and intermodal equipment providers to maintain driver-vehicle inspection reports when no defects are uncovered. The implementation delay was to make room for the revision.
The NPRM was drafted in response to a joint petition for rulemaking by the Ocean Carrier Equipment Management Association and the Institute of International Container Lessors. The groups requested that FMCSA rescind the part of 49 CFR Part 390.42 (b) that required drivers to file no-defect DVIRs. FMCSA’s NPRM removes no-defect DVIR requirements in applicable sections of 49 CFR Parts 390 and 396.
All comments on the no-defect DVIR proposal are due on or before August 8, 2011. The Docket ID Number is FMCSA-2011-0046. Below are instructions for how to submit an official comment on this Notice of Proposed Rulemaking.
