ELD Mandate Exceptions

There has been a bit of confusion regarding who and what is exempt from the upcoming ELD mandate, so let’s try to clear up some of the murky areas.

Manufacture date or model year?

According to the FMCSA, they intend to use a truck’s model year, not the date it was manufactured, to determine whether a driver needs to use an electronic logging device.  Only those trucks with a model year of 2000 or later will be required to use an ELD. 

Are there any other exemptions to the mandate?

Operators who fall into the following categories are also exempt from the mandate:

  • Drivers who are not required to maintain a log because they fall into the 100/150 air mile radius log exemption. However, they still need to keep time records.
  • Drivers who keep logs for no more than 8 days during any 30-day period.
  • Driveaway-towaway operators transporting empty vehicles.
