HazMat Security Plan Development

As the United States continues to be at risk for terrorist acts of violence, our goverment has been taking steps to protect the country.  In doing so, the Pipeline and Hazardous Materials Safety Administration (PHMSA) who issues Hazmat regulations established requirements to reduce this risk.  As part of these rules, all companies that transport hazardous materials in an amount requiring placarding as well as some new high-risk areas must have a security plan specific to your company as of September 25, 2003. These regulations are expressed in CFR 49 Part 172.

Estimating the cost to develop Security Plans, the government anticipates large business operations to spend $2,250 (50 hours).

The new Department of Homeland Security regulations add additional requirements for your Hazmat Security Plan

Has your security plan been updated to include the mandatory Department of Homeland Security requirements?
All Hazmat Security Plans must now meet Department of Homeland Security (DHS) requirements.  In May 2004 the DHS issued regulations that added additional requirements for Hazmat Security Plans.  The regulations at that time applied only to those regulated by the Federal Aviation Administration (FAA) and the United States Coast Guard (USCG).  A subsequent ruling was published making the requirements applicable to all modes of transportation including motor carrier Hazmat Security Plans.  It was a jointly issued regulation by both the DHS and the DOT.  In this issue we will tell you how we can help you meet these mandatory requirements and keep your security plans updated to be compliant with all of the many Federal agencies that regulate this activity.
 
IF WE DEVELOPED YOUR SECURITY PLAN
If Foley Services developed your Hazmat Security Plan, we will provide a comprehensive review and custom update to meet the DHS/DOT requirements as discussed in the September 22, 2006 issue (No. 457) of our DOT Safety Regulation Update FAST-FAX  – ($175).
We will:
• Add any updates due to changing requirements at your current location if necessary.
• Modify your plan to meet the current requirements per DHS/DOT requirements.
• Re-evaluate your company’s overall security risk.
• Print and mail your new plan.
• Include the mandatory Initial Security Awareness and In-Depth Security Plan testing materials to meet the requirements of 49 CFR Part 172.702(d).
• Provide written instructions explaining what to do with the new plan, what to do with your old plan, and if you need to conduct any employee training.
 
To help you comply with the new Hazmat Security requirements, Foley Services, Inc. has created a program of security plans and training services to help you develop your company-specific Hazmat Security Plan in a fraction of the time.

Three (3) Cost Effective Security Plans:

Option No. 1 - BASIC HAZMAT SECURITY PLAN –  ($450) – This Hazmat Security Plan is for small employers with limited risk.  Option No. 1 includes:
• Initial Security Awareness Training Video – This video meets the mandatory training requirements for both new and current employees.  It may also be used to meet your recurring training requirements.
• Custom Developed Security Plan – Our internally certified staff will work with you by telephone to custom develop your Hazmat Security Plan.  This includes a custom developed Vulnerability Assessment and Security Procedures.
• Custom Developed In-Depth Security Plan Training –  We will custom develop your In-Depth Security Plan Training (via a written document) that addresses the risk areas specific to your business.
 
Option No. 2 - INTERMEDIATE HAZMAT SECURITY PLAN PLAN – ($575) – This intermediate level Hazmat Security Plan is also based on telephonic consulting and includes the required custom developed Vulnerability Assessment and Security Procedures.  It is the ideal, cost-effective solution for most employers, except for those small employers with limited risk.  This option includes all of the features of Option No. 1, however the level of detail is expanded to cover security issues for employers with a higher risk or larger size.
 
 
Option No. 3 – ON-SITE SECURITY RISK ASSESSMENT, TRAINING, AND A CUSTOM DEVELOPED PLAN  – The highest level of Hazmat Security Plan development, which we offer includes an onsite visit.   This option is for employers who are concerned about security and want a high level of due diligence to meet their regulatory requirements in a most comprehensive manner.  Travel costs are extra.   This option includes:
• On-Site Initial Security Awareness Training Seminar – We will conduct live training to educate your staff on the Initial Security Awareness Training requirements and answer their questions. 
• Initial Security Awareness Training Video to be used to meet your initial training requirement in addition to the recurring training requirements for your employees.
• An On-site Risk Evaluation and an Internally-Certified Consultant to Custom Develop Your Security Plan – Our internally-certified staff consultant will work with you to custom develop your Hazmat Security Plan.  This includes a custom developed Vulnerability Assessment and Security Procedures.  A final written plan will be developed.
• On-Site In-Depth Security Plan Training – After the final plan is developed, we provide a written In-Depth Security Plan Training that addresses the risk areas specific to your business.  In addition, we will prepare a written version of this training and supply your employees with the necessary copies.
