How to Hire a CMV Driver

On October 30, 2004 the regulations changed significantly with regard to the new hire requirements that all employers of commercial motor vehicle drivers must complete. The liability of doing it wrong has also apparently notched upward as the regulations exempt employers from liability from individual applicants/employees, but only if the regulations are followed. With the litigious environment we live in it is highly advisable to meet the new regulation requirements. Foley Services has a variety of products, such as our all-new "How-to Hire a Driver" video training package, and services to assist employers. These range from a series of compliant forms, background checks including the new safety performance history investigations, to a full driver qualification file setup with an audit step to assure that all steps and documentation have been completed.

NEW PRODUCTS FOR COMPLIANCE WITH THE NEW PART 391 REQUIREMENTS IMPLEMENTED OCTOBER 30, 2004

 

Foley Services developed two ways to assist you in meeting the new Part 391 requirements. If you wish to use our services to comply with these requirements see Option One. You do not have to be a current Foley Services' Transportation client to select Option One. Your second option is to purchase our new Part 391-compliant products and do-it-yourself when hiring a new driver. The products mentioned below are available in packs, sets or individually.

OPTION ONE: USE OUR SERVICES TO COMPLY WITH THE NEW 391 REGULATIONS

The new requirements are difficult to interpret and tedious to implement. Foley Services wants to make it easy for you with our prescription for painless compliance. Simply follow the steps below and we'll take care of the rest.

STEP 1 - Purchase the How to Hire a Driver Training Package: We recommend this training in order to help you fully understand the new Part 391 hiring requirements. The 40-minute video will explain the 22 necessary steps for hiring a driver. The accompanying 42-page "How To" manual provides further detail and reference pages for quick answers to your questions about the new mandatory regulations.

STEP 2 - Purchase the Initial Screening Pak: The Initial Screening Pak contains all the materials necessary to be in compliance with interviewing and screening new drivers including the newly revised Employment Application form to meet the new requirements. You will need one Initial Screening Pak for each applicant.

STEP 3 - Have Us Complete the Mandatory Background Screening: We can complete the mandatory Safety Performance History background investigation and Department of Motor Vehicle investigation for any new driver you hire for a fee of $95 per driver. Send us the completed forms from the Initial Screening Pak and we'll complete this process for you. In addition, we will set up both a Safety Performance History Folder and Driver Qualification File for the driver at no additional cost.

DO-IT-YOURSELF

STEP 1: Purchase the How to Hire a Driver Training Package:
The How to Hire a Driver Training Package is highly recommended for all hiring decision-makers. The 40-minute video will walk you through all 22 necessary steps for hiring a new driver. The accompanying 42-page manual contains the entire process defined in further detail along with reference pages and illustrations.

STEP 2
- Purchase Initial Screening Paks Before You Start Interviewing Drivers: The Initial Screening Pak contains the required materials you need to complete when interviewing driver- applicants. You need to have these on file before you interview applicants and must provide one to each applicant. The Initial Screening Pak is a cost-effective way to screen applicants compliantly before you make your hiring decision. The Initial Screening Pak includes:

STEP 3 - Purchase Our New Hire Pak: The New Hire Pak is a complete package for the do-it-yourselfer and contains all the necessary forms required for every new driver you hire. Purchase at least one blank set to keep on file and more if you anticipate significant new hiring activities. The New Hire Pak includes:

New Hire Pak for DOT Drug and Alcohol Testing Compliance: This Pak includes everything mentioned above plus a Drug and Alcohol Testing Folder and set of compliant forms for completing these activities as well.

Each New Hire Pak contains Post-Employment compliance forms.

STEP 4 - Purchase the Post-Employment Pak for Compliance When a Driver Leaves: The Post-Employment Pak will help you comply with the new Part 391 post employment requirements. We provide an instructional version with a 15-page booklet (you will need one), folder and post-employment forms as well as a version with just the folder and forms (you will need one for each driver who leaves your employment).
