FOLEY SERVICES INTRODUCES NEW LOG AUDITING SERVICE

We are pleased to announce our new log auditing service. Our service is designed to save employers time and give peace of mind by reducing the hours employers spend reviewing their drivers logs and by ensuring that drivers are in compliance with the hours of service requirements. We can audit any type of standard log book and provide timely reports to alert you if a driver is not in compliance.

EMPLOYERS ARE ULTIMATELY RESPONSIBLE FOR COMPLIANCE

Employers are ultimately responsible for the compliance of their drivers. Consider the following interpretation from 49 CFR Part 395.3:
Question: What is the liability of a motor carrier for hours-of-service violations?
Answer: The carrier is liable for violations of the hours-of-service regulations if it had or should have had the means by which to detect the violations. Liability under the FMCSRs (Federal Motor Carrier Safety Regulations) does not depend upon actual knowledge of the violations.

WE PROVIDE COMPREHENSIVE REPORTING OF DRIVER COMPLIANCE

With our service you will receive a variety of important notifications and reports about the activities of your drivers. These include:

  • Notices regarding late and missing logs;
  • A driver violation listing that tells you which drivers are not in compliance and what requirements they are not in compliance with;
  • Management summaries showing both company and individual driver violation severity levels;
  • Dated hours of service recaps tell you how many hours drivers have left before violating the 60/70 hour work cycle requirement;
  • In addition, we will also send the following notifications to your drivers:

    • Violation letters informing them of any non-compliance issues
    • Congratulatory letters to let drivers know that they are in compliance with the regulations and violation-free

YOU'LL BE ABLE TO QUICKLY TAKE ACTION AGAINST DRIVERS WHO FAIL TO COMPLY

Our management recap report will list all violations in a range from minor violations to very serious violations:

1. Severity Level One: Indicates minor violations such as the driver incorrectly completed his log;
2. Severity Level Two: Minor violations in which the driver was within one-half hour of being rested and was in violation less than two hours;
3. Severity Level Three: Moderate violations where the driver was in violation less than two hours;
4. Severity Level Four: Serious violations where the driver was in violation up to five hours;
5. Severity Level Five: Very serious violations in which the driver was in violation for more than five hours

AUDIT ANY OR ALL OF YOUR DRIVERS EASILY

Our service allows you the convenience and flexibility to audit the logs of all of your drivers or only certain drivers on a monthly basis. We also have the ability to spot check particular drivers for you. This feature of our service will help you check on problem-drivers to avoid potential penalties or fines. Remember, you are ultimately responsible for the compliance of your drivers.

HOW OUR SERVICE WORKS

You simply fax, email, or send us your driver logs each month and we digitize them into our computer system for analysis. We verify if your drivers are in compliance with the hours or service regulations and generate all of the reports and letters we just mentioned. Once the reports have been sent we will then send your drivers new log books and store the old ones for six months. After the mandatory six month retention period we can destroy the log books for you at no additional cost, unless you request them back.
