Our illustrated booklet is 12 pages. Quantity discounts are available. EMPLOYER REQUIREMENTS – Employers have two primary responsibilities with regard to post-accident testing. Employers must conduct testing on their drivers when the post-accident testing criteria have been met and employers must train their drivers on the post-accident testing requirements. Consider the following from 49 CFR Part 382.303(f): “An employer shall provide drivers with necessary post-accident information, procedures and instructions, prior to the driver operating a commercial motor vehicle, so that drivers will be able to comply with the requirements of this section.” DRIVER REQUIREMENTS – Drivers also have two primary responsibilities with regard to post-accident testing. Drivers must remain available for testing following an accident. Additionally, drivers are required to submit to post-accident testing as with any mandatory test. Failure to submit to post-accident testing is a violation of the prohibitions and subjects a driver to the entire return-toduty process. WHAT IS COVERED IN THE TRAINING BOOKLET – The topics covered in our training booklet include: • Who is subject to FMCSA post-accident testing? – Employers and drivers are subject to post-accident testing depending on the types of vehicles they operate. • When does FMCSA require post-accident testing? – The requirement to test is dependent on types of injuries sustained in an accident and type of enforcement action taken against a driver. • Testing reference table – Included is a handy reference table that clearly indicates when a postaccident test is required based on criteria of the accident. • Time limits for conducting post-accident testing – There are no time allowances when post-accident testing is required. Alcohol and drug testing must be completed within their respective time periods. • Driver responsibilities – A driver must remain readily available for testing throughout the required time periods. The booklet clearly depicts what it means to be “readily available.” • Refusals-to-test – A refusal-to-test has the same DOT consequences as a confirmed positive test result. We explain what could be considered a refusal-to-test in a post-accident situation. • Real-world scenarios involving post-accident testing – While the Federal Motor Carrier Safety Regulations (FMCSRs) define the post-accident testing requirements we take it a step further and provide real-world scenarios that put the requirements into practice. • Tips – We have added several “tips” acquired from our years of experience to summarize your requirements in “plain-English.”
