DOT Compliance Question of the Week: FMCSA Post-Accident Testing

Under what circumstances does the Federal Motor Carrier Safety Administration require post-accident drug and alcohol testing?

FMCSA has very specific criteria to determine whether or not post-accident testing is required. DOT-mandated alcohol and controlled substances testing is only required when one or more of the following criteria have been met:

  • A human fatality has occurred.
  • The CMV driver was issued a citation for a moving violation and an injury requiring immediate medical treatment away from the scene occurred.
  • The CMV driver was issued a citation for a moving violation and a vehicle had to be towed from the scene of the accident.
